A Federal High Court in Abuja has ruled that the National Broadcasting Commission (NBC) can no longer impose fines on broadcast stations in Nigeria. The court issued a perpetual injunction preventing NBC from imposing fines in the future, and voided the N500,000 fine imposed on 45 broadcast stations in March 2019.
The judge stated that NBC lacks the power to impose sanctions as punishment on broadcast stations, as it is not a court of law and the NBC Code conflicts with the Constitution.
The Media Rights Agenda had sued NBC, seeking a declaration that the sanctions procedure was a violation of natural justice. In a separate case, the court granted MRA permission to sue NBC for failing to provide information on its independence and the sanctioning of broadcasting stations during the 2023 election campaign.
